Herbert is a man, by all legal and logical definitions, if HE is sexually attracted to females (women) then by definition HE is a heterosexual person.

Don't know, some undergo gender reassignment and some don't, they just dress and identify as another gender.

The sub judice rule regulates the publication of matters which are under consideration by the court.
Matters are considered to be sub judice (Latin for 'under judgment') once legal proceedings become active.

Criminal proceedings are deemed active once a person is arrested, a warrant for arrest has been issued, a summons has been issued or a person has been charged and remain active until conviction.

No, naming him isn’t a problem per se. Simply naming somebody does not compromise a subsequent trial. If charges proceed, and the guy ends up in court, we will all know his name anyway. The risk to the mail is mostly arising from the question, what happens if he’s not charged? they are open to a civil action for libel at that point. It is with that in mind that they have led their coverage with all the quotes from neighbours saying what a lovely unassuming guy he is. They are defending themselves pre-emptively against any claim that they have damaged his reputation.

Remember that guy who was accused of murdering a woman, even arrested, on all the front pages and then it turned out to the lorry driver? That wasn't good.

Yes, and these days, with that case very much in mind, newspapers are supposed to balance the right to privacy against public interest, under the provisions of the human rights act. But these are still civil matters, not criminal ones. Naming him doesn’t expose the mail to criminal charges or compromise his chances of a fair trial. It *might* be grounds for him to sue them, but again, really only if he’s not eventually charged/convicted, or else what detriment did he actually suffer?
