And it looks like the Government is tightening up RIPA, with RIPA soon to require that interception can only occur with customer consent that is "freely given, specific and informed".
Admittedly, the actual phrasing may change as they are just consulting at the moment, but the end of consultation is on 7th December.
Not unexpected, seeing as that is basically what the directive the act is based on says, but good anyway..

Hmmm..they are certainly talking the talk but will they walk the walk?

To give the consultant's answer - it depends....
If they use it for traffic analysis for shaping/management, probably not. If it is used to provide info for targeted marketing, probably yes.

Nope. Network management will remain legitimate use of DPI and remain exempted from RIPA's interception provisions.

Nearly as many as there would be on users' faces when the networks either became hopelessly oversubscribed or hard monthly bit caps and pay per GB services were introduced.

These are my favourite comments

How about £10,000 for every *individual* interception (even if it's two 10 min apart against the same account)
|
I wonder if that's from the same person who is trying to invoice a major Telecomms company £10 for every time they accessed his publicly available website?

who colluded with BT/Phorm (and TalkTalk/Huawei) are kicked out of the civil service... I can't see much to gain by contributing a response to a Home Office consultation now.
Because he problem is not, and never has been, the legislation.
The basic fault is the collusion of the Home Office RIPA Unit with BT/Phorm. And shady politicians. Not forgetting the Police, ICO, Ofcom, GCHQ, and the Security Services.
|
mmmm, those comments sound a little familiar....

Considering my post was 6 months ago, it would seem I'm not the only one....
