Dabs.con again!

Ok kind of following on from a previous thread but a different issue, I reacently sent back an Abit FX5200 graphics card that was purchased from Dabs on 11/12/03. I realise the card was faulty about 3 weeks before the warranty expired (luckily!) and so initiated dabs' online return procedure and paid the £10! to get them to book parcel force to pick it up. The pickup date was the 18/11/04 but Parcelfarce arrived 3 days late to pick it up. They then 'lost' the parcel on route to dabs at their manchester piccadilly depot, but according to them it did get delivered, just not signed for. Anyway the card reaches them sometime around the 30/11/04 and they emailed confirming it was faulty and was being sent to the manufacturer. Got exactly the same card back a couple of days ago (wrote do the serial number), stuck it in a machine, same fault, tried 2 other working machines, same. Just contacted Abit directly and they say there's no way they could turn around a repair in 2 weeks, but they do send details of any action taken of faulty goods back to the sender. Dabs claim it was rapaired but they were given no details. The fault was the there was no output from the DVI port. Only discovered a few weeks ago after getting a new tft (which works fine on an identicle card). Seems to me like dabs received it, kept it a few days until the warranty had run out and then sent it back. Any tips on what to do next? I know it's only a 5200 but it's still £40.

I am not sure but do you not usually get a months warranty (or similar) on a "repaired" item? If so, you should be able to get it repaired or replaced under the previous repair's warranty.

Ah good point, forgot about that, the only problem is I don't know if a repair was attempted, the email back from Dabs says 'We can confirm the item was tested as faulty and returned to the supplier for repair. Unfortunately we do not have the details of that repair.'

It does not matter whether the "repair" occured. Dabs admitted that it was faulty and was sent for repair. If the item was still faulty, then the repair either did not take place or did not work and as such Dabs are still liable to replace or repair it under the original instructions.
