No, certainly not. However, given the current state of panic in the banking world over this many are changing the wording of their service agreements so you may encounter a similarly worded caveat in any new banking agreement which you enter into.

Which is why the guy who started this whole thing rolling advises people to take out a new account first, then put the claim in.
As for agreeing that they ( the bank ) were not in the wrong, ( who can decide this now? )

The advice to open new accounts prior to claiming was to have a safety net if the respondent elected to close the claimant's account in the event of a successful claim for refund. The "future charges at the newly reduced rate" clause only became a tactic on the part of the banks after the April 6th OFT report.

Re: Reclaim Your Bank And Card Charges
My bank have just charged me a total of £60 for going overdrawn for a total of 2 days by about £5.
I am sure over the last few years LloydsTSB have had a lot of money off me. I really should look through and work out how much exactly it is and write to them.

Re: Reclaim Your Bank And Card Charges
Shabby decided to only refund part of my charges as a "Gesture Of Good Will" so i went to the FOS. They settled 100% after a few Months but tried to close my account so that i couldn't get at my money. The FOS threatened them with legal action and i now have paid off my overdraft and £1,225.90p to spend
I was thinking of buying a Ford Capri but then i realised i can't drive
Seriously, try the FOS before you part with any money for court action. People say that they're a toothless tiger but they came up trumps for me
