Disability benefits: Ministers revise assessment regulations

Regulations governing eligibility for benefits for disabled people will be changed after criticism of their likely impact, the government has announced.
As a result, how - and not just whether - a claimant is able to accomplish tasks like walking and planning journeys will help determine the amount they are entitled to in benefits.
Claimants who manage the tasks, but not "reliably", will get higher payments.

But who is going to be making these judgements?

Have they really changed and listened with a slight of hand they even moved the goalposts even more. Without disgusing in parliment. Absolute sickening this coalitions is dont buy into they changed. They evil pure evil.

They're still using ATOS it seems

I'm dreading it, already losing sleep and feel ill just thinking about it.

Good luck adam. May I advice to seek help like CAB, doctor etc filling it in there is some sneeky traps in the questions which I am sure has caught many genuine cases out.

I hope you also get atos doctor who knows your condition too when you are called. You must be going through hell worrying. All I can say is I hope things go well for you.

All they are doing is putting something explicitly in the text of the law, that was in the rules anyway. That was already there in the guidance to ATOS and the Case Managers(as they are now known for PIP). This is meant to be applied to ALL the activities, not just mobility.

3.3.1.
Central to the application of all the activities within the PIP assessment is a consideration of the manner in which they are undertaken. If an individual cannot reliably complete an activity in the way described then they should be considered unable to complete it.

Focus on what the rules actually do say and make absolutely sure that ATOS etc and the DWP are educated in them. Don't keep spreading myths or else they will become fact, as people go on to believe that they must be true as so many people are saying it.

I would advise you take a device capable yourself with you. You have the right to have the medical recorded however this was leading to massive delays due to lack of availability. Now they will not delay an appointment if no recording hardware is available

I would also advise that you phone the DWP about a week after your assessment and ask for a copy of the ATOS examiners report.

Adam try to keep calm and not let it overly affect you i know from experience that it's easier to say then do but if you let it it will do you even more harm also speaking from experience. I have zero trust in this government to play fair on anything anymore they lie, twist and misrepresent all the time on the issue of benefits purely so they can attack without the majority of the public being aware of how bad the vulnerable are being treated right now.

they have to, i know it causes a delay, mine got put back three times but having with out a recording could prove costly

to get letter templates to send in they were very useful to me

remember from experience they will lie to you on the phone and go on about loosing benefits if you don't take the next available test but at the moment they can not take your benefits off you while they get a recorded session sorted out

There are some horrific stories out there but, my friend was recently contacted by phone but unable to speak to the assessor, he had filled the form in beforehand. His wife said he wasn't fit enough to speak on the phone that day.

He was not called for an interview. Several weeks later he received a letter saying his benefit will remain the same, & he is not required to attend any work related interviews.

Thanks, yea I sent off the form two weeks ago or so, I forget when

Now I have to play the anxious waiting game.

Very uncomfortable feeling.
