That would be because you can resell them. The MPAA would prefer you not to but as yet they cannot prevent it.

Or if you are carlwaring, you'll just ignore the fact you were corrected and continue to argue other points.
It doesn't matter where you download the ISO as long as it is clean. It could come with all the cracks on the planet in another folder, but as long as the ISO itself is clean and it's been activated with a genuine license, then it shouldn't be an issue, plus, TPB doesn't offer anything for download, it just provides links to links that point to a location.
It's only illegal if you crack it after you've installed it.

Actually not true.. The ISO itself is intellectual property (licensed or not) and I'm sure that Microsoft themselves do not license all the sites that Microsoft ISOs can be found on.. By downloading on a P2P site you could also be guilty of sharing it even if you have your own key..

Three years ago, I bought a cheap Compaq tower, can't reemmber which model now. It came with Vista Home Premium. Which wasn't actually that bad of an OS. However, it was absolutely filled with HP/Compaq.... I want to use a C word, but I will just say "tripe" instead.
It even had an EULA from Compaq that I had to agree to before it'd let me use the hardware. I spent 3hrs trying to uninstall all that tripe. Eventually, I gave up, and went out and bought a retail copy of Vista Home Premium.
I could have downloaded a slipstreamed ISO like my friends suggested, but, yeah, I agree with Kymmy. Even the ISO is intellectual property. Even if you own a valid licence, it does not authorize you to download a copy. The licence only applies to the copy that came with the PC.
Turns out I wasted my money, as my best friend bought me a custom built Alienware desktop for my birthday a year later. With Windows 7.

I think it's a bit of a gray area... i haven't read the EULA so i guess i shouldn't be so sure about what i'm saying.
I guess what i'm doing is mixing morals in with legality, to be fair, it isn't morally wrong to download an ISO and register it with a valid key that you own or have paid for, but then you can download the ISO for free from licensed sources.

The license authorizes you to install and activate the copy of the software upon which it grants you a license too. It doesn't only apply to the pre-installed OS.
In some cases your recovery software will be locked to your specific motherboard, so that can't be used on another machine, but the license itself is not.

Indeed. That's the problem. Certain people just cannot accept that it is wrong and will find any "excuse" they can to justify it.

Personally I'm not surprised because it is a very grey area... Most software is available from free downloads with only the activating licence being paid for.. that still doesn't mean that any site can take the install files and make it available for downloading. It would though be extremely rare for action to be taken and most OS install ISOs available on P2P/usenet are packaged with a dodgy key/activation program.
Also microsoft have removed most of them (if not all by now) of their public downloads for these ISO's to being behind subscription (MSDN) or licence checking servers (most microsoft digital dealers) which demonstrates how they perceive their own license in regarding to the install media.
Saying all that though doesn't make it wrong to download all ISOs and it does depend on the licensing.. It has though until recently been upto the individual as to where they get their install media with some people willing to go to social distribution (p2p/usenet) with only the recent closing of some file sharing/indexing sites which isn't though the reason for their closure but instead a side effect of the entertainment industries campaigning..

Yep you are wrong.. The licence can be transferred from PC to PC as long as the original software was not deemed OEM.. Microsoft though does have hardware checks built into their activation programs purely as a protection to their software being used on more than one PC at the same time.. It can cause issues and fail the automated activation but if you push your case microsoft will activate it on another machine as long as you don't have it still on a previous PC and you can prove that you are the original purchaser..

My technet licence states this.
It authorises me to download software from the technet site. I am also allowed to keep the iso's on my own storage space as long as its not publically accessible.
Thats pretty much it really in terms of downloading, what I do know is that some web sites hosting the clean ISO's (no cracks etc.) which would of course require a key to work past 30 days were told to take down the images.

correct. My EULA states that the software is licenced for upto 2 processors so if i shove a quad core in, it will require re licensing
I think this is the key phrase in licensing

Basically i understand that to mean you never own the software ,you only purchase a licence to use the software therefore any like for like copy of that software can be used i.e windows 7 hp can be reinstalled with another copy of windows 7 hp and not Ultimate ,as long as it is a genuine copy of windows 7

Quite the opposite. As can be seen from this site, the first Google result for "Windows 7 free download", all versions of Windows 7 remain freely available for any member of the public to download from Microsoft's own digital store servers, without any subscription or license checking.
In fact, they used to require a login but no longer do, having opened it up to everybody now.

I wish they'd make up their mind.. Originally they wouldn;t allow ISO downloads apart from technet, then they opened it upto everyone then they dropped it down to licensed retailers only then they opened it up again, then clamped it down and now Quasi says they've opened it up again....
Either way though licensed sites whether behind closed doors or not are still microsoft sanctioned.. That does not though include all P2P/usenet sites
