Luckelly for him he has his email proof as that forms part of a legal contract 
(terms agreed at time of sale become part of the contract even if it conflicts with TOS and/or the person had no authority to give it)

It depends how far you want to take it. Such a thing DOSE form part of a legal contract, its just upto yourself if you wish to take it all the way to court (with the costs involved etc). I know i have taken a simmilar issue to the small claims court regerding claims made by a sales person on the warrenty on a TV i brought some time ago
and funny enough my case was baised mainly on verbal agreement (with notes I had made on the paperwork)

The contract is for the services he still has. The £80 install fee is for difference services yet to be ordered.

the service i still have was based on a renewal. which was done expressely on the condition that i would not pay a setup /etc fee for the upgrade as i wanted 50mb. i made it clear that i did not want to renew if they would charge me for an upgrade in a weeks time if 50mb appeared in my neighborhood. it was part of the verbal contract and understanding, and the email they sent through clarifies the situation - that my plan has been renewed and i do not need to pay for an upgrade to XXL.
i'm more than willing to take this to small claims court if they go back on this, i've done it with O2 where they ended up reimbursing me £300 for a £36 error the day before i was going to file at the courts. i'll no doubt fight virginmedia to the end on this one.

For all those saying they have a verbal/e-mail agreement saying you would get the £80 refunded, I am not saying you won't get it, but you will have a lot of 'Oh I don't know about that' and 'Ill have to get the original advisor to contact you etc'.
Sales do not have any way of refunding that, so don't expect it not to be charged. You will then have to wait for the credit to reverse it back off the account

And for those asking for areas, I refer you to back to Post #27 which says
