Well let's hope this never happens to you..and you are happy paying out for 6 months of a contract if it does
|
Why do some of you people always expect VM to do something that NO other company would do?
A 12 month contract is just that - If you leave after 6 months VM more than likely make a loss overall. Its a business not a charity.

You can cancel without being charged for the remainder of the contract.
I've done it before, as have others, if CS wont let you then you speak to a manager, simple as.

Some thing not right here.
Any one here who has any knowledge of VM will know C/S or C/S managers do not disc customers who are moving address,!!!!!!

You are aware that VM ADSL does not exactly get rave reviews, are you?

And they already use application throttling on their ADSL packages.

Re: Moved house, can't get Virgin, but they won't let me terminate contact
I was in a similar situation earlier this year, was into the 2nd month of my 12 month contract when our landlord, decided to sell the property. Uber pain in the rectum time.
Got a quick move, but......the new flats where not cabled up, even though the street was.
First VM customer support, was just wanting me to stump up £250 notes or else. Was rather miffed at that response, especially if i had to pay 125 notes to BT.
One week later, BT said, the line is in, so all we have to do is enable it our end..so no charge...yipeee, Straight forward no probs.
Contacted VM again, to cancel and pay up my Cable contract, new person, then informed me, well you do know you can get Virgin ADSL on your new BT line. They then swapped my package over, NO CHARGE or cancelation fees But they did state it is a new 12 month contract. I can live with that, as it saved me 250 notes. Even if i did stop my new contract it would be far less than, paying up my cable one.
So happy bunny time, that I saved money and kept some sort of internet access. Scartchy at times yes,so are most of the standard ADSL firms.

I don't have any choice because I can't afford to pay a disconnection fee. As for the application throttling, oh well.

I am hoping, in a similar way that DOCSIS 3 will help for cable broadband, the LLU C&W network will help even out the standards ADSL service and make everything better lol

Erm no it isn't contracts work both ways, you aren't providing him with the service, we have dealt with this many times before and there is a tried and trusted path to resolve this issue to the satisfaction of the customer, I am busy right now but if no one posts it, I'll find it when I get in later

I'd consider one party to a contract insisting that you can't move house to a location of your choice to be pretty much to the detriment of the second party, wouldn't you?
Additionally, from Schedule 2 of the act, all of the following are considered "unfair terms" and are, as such, legally unenforceable:
(c) making an agreement binding on the consumer whereas provision of services by the seller or supplier is subject to a condition whose realisation depends on his own will alone;
(d) permitting the seller or supplier to retain sums paid by the consumer where the latter decides not to conclude or perform the contract, without providing for the consumer to receive compensation of an equivalent amount from the seller or supplier where the latter is the party cancelling the contract;
(e) requiring any consumer who fails to fulfil his obligation to pay a disproportionately high sum in compensation;
|
Here is the thread makes interesting reading methinks, Mr Angry once again, sorely missed imo

It does not say that you can't move. It does however say that if you move and don't carry on with services, THEN you have terminated your contract.

Again I direct you to this clause (K2)
Quote:

If you move to another address during any minimum period paragraph J2 will apply, unless you continue to receive our services at your new address (in which case paragraph K3 will apply).

Virgin calculate the disconnection fee to be less (or the same if on a minimum bundle) that the service charges, so is not disproportionate

Be does, as do several of the Entanet resellers (I'm currently on Be, was on ADSL24 before that).

Re: Moved house, can't get Virgin, but they won't let me terminate contact
This is the unfair bank charges thread, just applied to a different scenario of Virgin Media cancellation.
Just because something is written into a contract, does not mean that it is indeed fair and legal with regard to other legislation. A company may well have had lawyers pour over the contract, but unless it get's tested by a court, they don't really know do they. After all whenever a case goes to court there is usually a winning and loosing lawyer.
Bottom line, most VM customers just roll over when confonted with a big corporation claiming it's lost out.
I reiterate that whilst there may be some charges to pay, they should relate only to the actual losses being incurred by the cancellation, and that in no way should equate to the full unused contract price.
If it did equate Virgin would effectively be saying that they operate at a loss. Oh hang on, maybe that's why there are so many comments about poor network investment, STM and the like
