Sold a tyre on eBay

Hi,

My partner sold a tyre on eBay for £15 - collection FOC or delivery for £10 within 15 miles.

Some guy bought it who was about 40 miles away - we where not very happy that he bid as we had stated the conditions of delivery on the auction.

So - she decided to sell anyway with the buyer paying £15 for postage.

When the buyer recieved the tyre he mail to say that there was a repair on the tyre wall.

In all honesty she did actually forget about the repair as the tyre is about 3 years old and had been siting in the garage. (BTW - the tyre was on a car for about a few weeks and has very little use).

When the repair was done, the garage told her her that the repair will be ok and road legal - if not - they would not have given her the tyre back (or would have replaced it).

The buyer now says he's had a visual inspection done and it's unsafe.

At the moment we've asked to see the inspection report.

Any idea's where we stand on this?

We coud of course do the right thing - get him to send it back (at his expense) and refund the cost of the tyre only. (It would cost about £14 to return it to us by ParcelFarce)...

hmm.. well to be fair, you're selling something different to what you were advertising, and I certainly wouldn't be happy in that situation.

.. and I wouldn't see why I would have to pay to return it, since what I paid for, wasn't what I got - sorry

Tell him the tyre was sold under the genuine belief that it was road worthy and that you had been informed by a garage it was road legal.

Next offer him a refund of his money subject to him paying the postage as he believes it is unsatisfactory but you believe it is.

If this is unacceptable, stick to your guns and take the negative feedback. Some idiots like to use that fact you have good feedback against you but in the big picture its not so important to have been given the odd one.

What condition did she describe it as? (Link to auction?)
What repair? - had it been slashed or just a nail?
If it was described as nearly new, or similar, prob best taking it back - he might expect you to pay for it to get back to you if it's nothing like the description.

I was under the assumption that if you had a puncture in the wall of a tyre then it couldn't be repaired.

Im not sure why anyone would willingly buy a tyre off of eBay anyway, it depends on the size of course but they're not really that expensive, is he going to re-tyre his car with random tyres from eBay or something?

It was repaired by a main dealer (I think they sent it away for repair).

It came back repaied and road legal.

The annoying thing is as well is the fact that he bid on it despite giving the delivery details!

Interesting info on tyres ......

The TIC also pointed out that although tyre manufacturers add anti-ageing chemicals to rubber compounds they are only active when the tyre is in use; therefore tyres fitted to spare wheels, caravans and trailers are particularly at risk of premature ageing brought on by ozone degradation and static 'sitting' for lengthy periods. Hence if an unused tyre reaches six years old it should not be placed into service.

Well it still has a few years to go and for £15 for a used / virtualy new tyre you cant complain - just make sure you change it out in two years.

OK - so it was described correctly would you say? (apart from the lack of info on the repair itself)
