On another note if a line is steady and can hold 50 customers max and be able to maintain what they advertise and sell then surely adding more you are in effect stealing from current customers going beyond what it can hold?

Or is that VM's get out at all times by saying "upto?" because I can max out my BB now 105mb so there may come a time I only get 70mb and I will just have to suck it up in VM eyes

Maybe the latter but not the former. (ie no "stealing" involved. If you don't believe me, look up a definition of the term.)

Yes. All consumer broadband services are provided on an "up to" basis. It's simply that with fibre you are more likely to get the headline speed than with ADSL.
