Re: Thug has bail curfew lifted so he can go on holiday
But the law has been enforced, as far as I can tell. There are presumably provisions in this particular law that allows a variation, but only if ordered so by a judge. The law would have been broken if he simply went on holiday and did not ask for permission.

do you think though that the spirit of the law in this case was abused
i feel sure that the the exceptions were not meant for people such as him

Either that or his lawyer requesting the variation in the conditions gets another legal aid payout. I know which one my money is on.
Besides the going rate for a breach of bail conviction in Scotland right now is 1 month in the pokey. This is cut in half automatically plus extra early release drops that down to a couple of days at most and means pretty much any bog standard bail breach doesn't actually incur any punishment.

But who else would they have been meant for? If criminals are allowed these considerations, then he was just as entitled to it, as any other thug would have been.

well i would have thought on a case by case basis ,lesser criminals like shoplifters or non violent crimes would be allowed these considerations not someone like him

Re: Thug has bail curfew lifted so he can go on holiday
I would have thought that the criteria would be more based on whether the criminal was flight risk, rather than what they were convicted of.

considering that his current offences occured while on police bail i'm surprised he still has his liberty never mind being allowed to go on holiday .How do you judge if someones a flight risk untill they actually abscond ?

I have no idea, I am sure the judge would have taken that into consideration. Perhaps his mother put up a good case to serve as his "minder" to ensure that he returns. I didn't see anything about his bail being increased or not. Maybe they put the bond up?

Lot of assumptions, presumptions, maybes, and perhaps' being floated around.....
Hopefully the same open-mindedness and even-handedness will be equally distributed in other topics.

Re: Thug has bail curfew lifted so he can go on holiday
All that should have happened is that he should have been made to surrender his passport regardless of the holiday being pre booked.
I wonder if the same judge would have let a juror go on holiday even if their holiday was pre booked.

It's in Scotland so a little different with no money involved. He will have been charged with an offence sufficiently serious enough that being remanded might have been an option.

Once you get any curfew or ASBO, the law should be enforced and these should be enforced, next thing the law will allow yobs to go to Florida, so that dolphins can teach them how to behave on the streets.

I doubt he'd get into the US with a crimianal record.

No yob with a criminal record will get into the United States of America unless they apply for a Visa from the US Embassy in London and provide a thumbprint, and only if the offence is deemed to be not serious will they actually be granted a Visa.
How many yobs can you see doing that when then can go to Benidorm for a lot less.

I'm not sure if having to go to see Lady Gaga is more punishment than being on a curfew.
