What if they make a mistake and the phone does belong to the person they're raiding? What with all these new powers, they might as well declare joblessness to be a crime and have done with it! See you in jail!

Basically where the true owner of the phone can't be established and/or the phone contains crime related info that could be used to commit further crimes. Not sure what's so controversial about those 2 reasons.

No, I agree those make sense, but will it stop there? IMO they have too much power already.
