Looks like it is just an extension of the proceeds of crime laws that already exist

Basically where the true owner of the phone can't be established and/or the phone contains crime related info that could be used to commit further crimes. Not sure what's so controversial about those 2 reasons.

Why not wait until it goes further or get misused before scaremongering?
You can make the same allegations on pretty much anything.
