As far as I know there has been no announcement about any of the traffic management details on the new tiers, so it's not a given that what management is on 20Mbit now is what will be on the upgraded M/L 20Mbit

Once again, the BBC article does mention it:

However, I think it's fair enough- the 10 (soon to be 20meg) service is a basic service. If you find you're hitting STM a lot, you should probably think about upgrading, even if you don't need the extra speed. I know plenty of people who'd happily stay on 10meg and throttle it 24/7 if they could, rather than pay for 50 and only use it 4-5 hours a day.

That's a pretty general statement though. Until full details are published we don't know exactly what the changes are

Although I do appreciate this is the internet, so wild speculation is always preferred over waiting for facts

If i were virgin i'd increase the the throttled speed from 5mb to 7mb for the new 20mb tier and increase the amount allowed to download till that is triggered. That way hardly any customers will be affected by netflix hd.

Netflix u.s has 1080p btw, u.k doesn't at the moment, i'm sure that will change in 2012/13 in which case virgin would get a ton of complaints for throttling. Virgin need to start figuring out their strategy for the 20mb tier in regards to this.

They could just allow users to use iplayer/netflix/lovefilm and not count that bandwidth towards their max allowed amount before triggering 5mb that would solve everything but can't see virgin doing that.

I am on the L 10mb and they have never offered me the 20mb service when i asked for an upgrade. all they quote is the 30mb and £30 fee

You have to remember that Virgin needs incentives to get people to upgrade. The 20Mbit will be the lowest tier they offer, it's the baseline, the equivalent to BT's lowest which has a 10Gb usage limit, or even the 40Gb usage limit - imagine how quickly you'd hit either of those with streaming.
