The “power” of a company secretary is limited and is usually tied to what, if any, other responsibilities they have at a given company. Many just work one or two days a month for a company (most who do this will be company secretary for several companies) to fulfil their administrative duties. Outside of this they would have no involvement with the running of the business.

On the other side of the coin the company secretary may also be the Finance Director in which case they would be involved at a very high level.

The company secretary would seem to be an odd choice of person to write to about customer service for these reasons. That doesn’t mean it won’t work of course. As you pointed out, after a number of letters to his home he may well ask someone who can do something about it what is going on.

Hi Daneel,

Without getting into too protracted an explanation involving the constructs of Company law the short explanation is that the Company Secretary assumes criminal liability for defaults of any Limited or publically owned company.

From that perspective, and for the purposes of what we are discussing here, the Company Secretary is a much more viable avenue for the resolution of disputes or complaints in respect of contractual obligations than a company director / shareholder.

Directors are culpable for those legal responsibilities under Company Law (not necessarily criminal offences) to which they subscribe. The Secretary, however, is responsible for a very broad ranging gamut of legal obligations (both statutory and criminal) in respect of the carrying out of the daily affairs of the business at hand.
