What she's forgetting is that the guy that she was having the affair with also confirmed that he had the affair to her husband and so he would also have in some way ruined her life and marriage so why not go and sue him as well.

There you go - assuming rationality in an emotional situation (and obviously, she wasn't being rational, as it was only a short-term (three weeks) affair). I have had colleagues who have discovered their partners were "dallying" by the itemised home phone bills - you would have thought they would have used a mobile, but it never occurred to them, being in emotionally high (the new romance) and low (worrying about showing how happy they were) states.

There's a lot of "ifs" floating about - I am sure it will all be revealed in court.

Quite - the divorce courts are littered with people who didn't act rationally for one reason or another and get caught. My ex sister in law is now one of them.
