Thing is nowhere on that page or in my flier is a 12 month contract mentioned. I was actually going to post about this asking if it would effect my pricing if I was to have it for a few months and then dropped it. It does look to me like its a tempting offer for existing customers to try the services. Sky do it all the time trying to get me to try movies and sports free for a couple of months no strings attached. It would not surprise me if VM do have hidden strings but if no one actually tells them me then I aint gonna be tied to them. As I said above Ben has already said its a new 12 month contract and I would take notice of him due to him working on that sise of the business as I am broadband technical support, but I also would say from reading it that it will start a new contract.

above is the final digitally agreed to terms and conditions of the order. Nowhere does it say its a new contract.

However it does say

Now I am contracted to XXL BB M TV and M phone. I have had this contract 4 months now so have 8 months left on my contract. If I upgrade freely for 2 months there will be 6 months left on my contract.

I could therefore see me being trapped although tentatively into the remaining 6 months of my contract with XL tv whereas at this time as per agreement above my minimum term will be over.

I could I feel legally argue that with the terms as per laid out on the offer in writting that the minimum term for the upgraded XL tv was 30 days.

These arguments are not based on what someone on the phone,you or Ben says its how I woudl argue it if VM decided to take me to court at any point for breach of contract.I would have in writting the terms and conditions to which I have accepted the offer and digitally signed in agreement to and I do not think the court would rule in VMs favour

As I said nowhere in the terms does it state a new 12 month contract is being accepted therefore in law VM can not argue I have started a new one

Here is the reply from a VM tech rep I was talking about, specifically in reply to someone asking about the 2 free months

Hi Mr
If you upgraded to XL package or any digital packager then you need to have
this for 30 days you can then down grade if you decided it wasn't for you.
You would need to speak to customer care to upgrade your package.

I didn't say it would start a new contract.

What I said is that you would be expected to keep XL tv. The 2 months is a reward for taking XL, it is not a free trial of it

so if I were to take this offer and then want it removing I would lose my discount meaning I would get screwed £45 for XXL?

I give no guarantees that you would be able to return to the previous bundle price.

Once again, the 2 months offer IS NOT a free trial, it is a reward for upgrading

Nope I do know the whole picture - which is the 2 months free XL tv is aimed at those want to upgrade, not those that want 2 months free and then want to downgrade

Unsurprisingly Virgin want to reward customers that take higher services

I am glad to see Ben clarified thing a bit more here.

I think that you can take the upgrade to XL for 2 months and if you then cancel within the first 30 days you will not be bound to any possible 12 month contract but just drop back down to your present tier, because it states in the link that advance charges will only appear in the 2nd months bill.

I forgot that you can cancel services within the first 30 days as I do not deal with these things in my job everyday.

If this is correct then you cannot have the 2 full months for free unless you stay on the XL TV package for the full term, but you should be able to get one month for free at least.

I have just upgraded to it. The lady told me that it will cost nothing and I can drop back down to L after 2 months have ended and it simple an 'XL taster'.
