i dont see why the innocent users have to suffer from bandwidth loss just because some thieving git decides to get through their content illegally. instead of traffic management they could just throttle the illegal downloaders? well of course if there was better evidence.

I am new to this forum,

it all those thieving gits who have to cause us a bandwidth loss. traffic management should apply to illegal downloaders. no limit on legal downloaders. agree? (of course evidence should improve).

Excellent call from Judge Birss.

Though he didn't say it was binding merely uttering the doubt of the legality of the case in court is a reference point for other cases before the law is clarified or changed.

I "note" from other places that this charade may finally end....

just to note a few points...

we seem to have gained a "knowledgeable" judge....
the "evidence" has been "torn to pieces"
the SRA are close to a decision
the ICO will have to get off the fence
a certain major ISP is about to incur the wrath of Privacy International
there are finally other law firms willing to have a pop at ACS et al

....oh and its stopped snowing

Oh dear...

its not going too well in court....

all of the "27" recieved letters saying their cases were being discontinued - some as late as Saturday

luckily they still turned up (or rather their representatives did)

Fat Andy however did not

ACS/Mediacat `s Brief stated "we want to discontinue...

Judge said no way hose

the representative`s of the "27" have asked/demanded a "wasted" costs of "sky high" proportions and it looks like they will get it too

Judge has said only the court can allow a discontinuance and insisted on a new hearing where Andy will HAVE to attend. Looks like judge will also insist on ALL parties to the claim attending

re convenes at 2pm i.e. 11minutes ago
