Trespasser wins payout of £567,00 0
Quote:
A TEENAGE boy who fell through a roof while he was trespassing on private property has received £567,00 0 in compensation.
Carl Murphy, now 18, sued the owner of a warehouse after suffering serious head injuries when he plunged 40ft to the floor as a nine-year-old in 1996.
Victims of crime groups yesterday reacted angrily to the payout, which is 50 times more than the family of a murder victim can expect to receive from the Criminal Injuries Compensation Authority.
Mr Murphy, of Seaforth, Merseyside, suffered brain damage in the accident which was said by doctors to have caused such severe behavioural problems that he was expelled from two schools in the two years after his recovery.
†œAfter all Iâ₠™ve been through, I feel I really deserve this money,ÃƒÂ¢Ã¢â€šà ¬Ã‚Â he said.

Re: Trespasser wins payout of £567,00 0
What!! how on Earth did he pull that off, what we reward criminals now and sue the victim.
Okay I shall go out rob three cars and cut myself breaking into a house, and sue the car owners for not fitting there brakes right and making me crash and the house owner for having shards of class behind the wall to make me hurt myself.
Then I can go to Spain for a year to recover.
Takes the MICK this does....

He won the case because the judge found that the company whose roof the boy fell through were negligent in not fixing a security fence, thus enabling the boy to trespass and hurt himself

Mr Murphy is currently living with his grandmother because his mother Diane and her boyfriend, Kevin Parsons, both 36, are serving three years in prison for setting up a heroin and crack cocaine business from their council house.

Ah yes, the 'stupidity' law - you have to take into account the fact that stupid little ***** will try anything, and you have to stop them...
Anyway, I'm off to stick my kn*b in the light socket, and then sue the makers for a million, because no where on the pack does it say you shouldn't do it.

It was a security fence - i.e. intended to keep out thieves, not a safety fence. Since it wasn't meant as protection of the safety of the public there should be no legal compulsion to have or maintain it.
Imagine a burglar breaking into your house, and breaks his ankle in the process.
Then he sues you because you didn't have a burglar alarm, because if you had then he wouldn't have broken in and hurt his ankle.
I just hope that since the company is 'now defunct' (according to the article) that there is no-one to pay the damages...
Of course the precedent it sets is possibly worse than the payout it awarded.

Anyone else think the company should counter-sue for damage done to the roof?
