Clearly then, they don't care what price VM are going to offer whether its £3 x 1m XL customers or even £20 per month standalone. They can afford to pass up £30m-£40m per year because they are not targetting television customers. That's where they are different to ESPN and Setanta who needed that revenue to support their venture. VM actually had all the cards in those negotiations. This time its BT with all the cards. BT also mustn't care about the potential advertising revenue loss if VM viewers don't have the channel.

So what's the stumbling block? BT want to deal with the customers themselves, we know that. They've shown that they are not interested in volume of subscriptions they just want broadband customers.

So have they told VM that they can have the channel as long as they control the subscriptions? In other words, they could offer the channel to VM at £2 per month as long as they get the customer names and details of who signs up. Would VM be happy to supply them with the details of possibly 1m customers? Its probably business suicide to do so.

We cable customers are potential gold-dust to BT, we'd all be targets for Infinity, telephone and tv and while BT is not something I'd consider there will be plenty of biters out there if the offer was good enough.

I'm not saying I have the answer, but it doesn't look as if the battle is over money. This is a battle for control and a much, much bigger prize than £2/£3/£12/£15 per month poxy television packages.

This is a good summation.

The whole point of BT getting this package for sports rights is to stop their own Phone/Broadband customers defecting to Sky.

short term i don't think its going to affect Virgin too badly.

However, once BT have completed their Fibre roll out to the vast majority of the country Virgin are going to be in trouble.

The guy i spoke to in retentions just now said there will be an announcement by VM in about a week's time, the delay (as speculated) is so as to get the best deal and the channels included in the XL pack.

I said many people I know would be prepared to pay an additional subscription for the channels but does he mean that if VM don't get a better price they won't pick up the channels?

He said he did not know but whatever happens there will be an announcement by VM before the Premier league starts.

I said I'd see what Sky offer me and I'll either jump ship or at the least downgrade my XL TV package and wait to hear what happens.

Once Infinity is rolled out, will the BT TV be any better i.e offer more channels or more HD than VM? if not what's the point in having TV with VM and Infinity for broadband, I suspect the majority of people look to have one supplier for all their needs, which VM do very currently

If you are unhappy about ESPN being removed from the XL pacjage, and you are in contract term, you should be able to cancel your TV service without too much of a problem.

There are 2 sections in the terms and conditions which cover this very scenario.

Section B - f

"Some parts of the services (for example, television channels that form part of our television services and other content on, or accessible via, our television services) are supplied by other organisations. As a result, due to matters outside our reasonable control or for commercial or contractual reasons, we may change, cancel or postpone all or any component part(s) of the services without notice, but we will give you reasonable notice of any withdrawals and changes where it is possible to do so. You will be entitled to end this agreement if the changes are significant, as described in paragraph J3."

Section J - 3b

"If we and/or Virgin Media Payments make significant changes to the services so the services you are entitled to receive in return for the charges you pay are significantly altered or reduced you may cancel those services affected without penalty by giving us and/or Virgin Media Payments (as applicable) at least 30 days' notice. Such notice must be given within 30 days of the increase in charges or changes to the services or this agreement being notified to you."

The loss of ESPN, ESPN HD, ESPN America, ESPN Classic, ESPN on demand and access to the ESPN channels via Virgin anywhere are very significant changes to your package. It's not your fault that the channels have been removed during your contract term. You didn't ask for the channels to be removed. You didn't agree to the channels being removed. The service without ESPN is not what you signed a contract for!

Remember about 7 years ago when the SKY basic channels where removed, Virgin allowed people to cancel their contracts using very similar terms and conditions.

Incorrect. Read back through the thread, 2-3 contract lawyers have already stated that it was outside of Virgins control therefore it doesn't apply. The reason people got out for the Sky Basics was because Virgin had said no to a new carriage agreement, therefore it was within their control.

The company that their carriage agreement was with, ESPN has closed, that is outside their control. They have to make a new agreement with BT to bring what is in effect a brand new channel back. The old ESPN does not exist anymore.

Remember however if you have a package for TV, phone and broadband you will only be able to cancel the TV part of your package.
