Sky Sports wins Ofcom ruling over BT Sport adverts
Ofcom has ruled in favour of Sky following a dispute over its decision not to carry adverts for its competitor BT Sport. The regulator said that it was reasonable for a broadcaster to discriminate against its competitors in this manner to protect its commercial interests and brand identity, Broadcast reports. "We accept that a broadcaster may in principle have legitimate commercial reasons to refuse advertising from a direct competitor on its own service," said Ofcom.

It added that the financial impact on BT of having to target customers in other ways would be "limited" as there were several other marketing opportunities to reach the target audience of ABC1 men. Sky's group director of corporate affairs Graham McWilliam said of BT's initial protest: "BT's demands are a bit like Tesco expecting to advertise inside Sainsbury's." Meanwhile, BT has again complained to Ofcom over Sky's refusal to supply Sky Sports 1 and Sky Sports 2 on "fair terms" for distribution via BT-branded YouView.

BT says that Sky will not allow the broadcast of these channels over BT boxes unless it offers Sky its own BT Sport channels. It argues that it should not have to do so as a newcomer in the market, compared to Sky's contrasting obligations as the largest player, while also noting that Sky will allow Sky Sports to be featured on TalkTalk-branded YouView boxes.

The regulator has opened an investigation into this "alleged abuse of a dominant position" by Sky. BT said: "We are pleased Ofcom has decided to open an investigation as we believe Sky has behaved in an unreasonable and discriminatory manner. "This is because they have refused to provide Sky Sports 1 and 2 to BT on YouView on fair terms whilst providing them to other pay TV retailers such as TalkTalk." Sky has dismissed this new complaint as being "entirely without merit".

That's a ridiculous outcome and totally illogical argument Sky have made!
I could see the point if BT were showing the same games, but they're not. Customers will be subscribing to two services to get the full suite of games. The competition only occurs at the bidding for the rights, which has now passed.

Seems strange that Sky don't see this as an opportunity to sell more to their own customers.

I feel Sky are definitely the magpies of the TV business...

I actually agree with sky on this one, if bt won't let sky sell their channels to subscribers why should sky pet bt sell skysports, this is also why virgin doesnt have bt sport.

Whatever happens I reckon VM cutomers will end up paying more to watch premier football next season. Even if they just stick with Sky sports they'll only be getting 116 matches instead of the 131 of last season all for the same money. Can't see the other 38 BT matches being free to VM customers (XL).
