Edit - Wait a minute... you had 100Mb installed today and the downgraded on the same day ??? Is your fluctuating speed not more down to your wireless connection or the speedtest site?

How many activation charges would he have paid?
I think he's going to get a few awards:
- World Record for change in broadband speed over a period of 3 months
- VM's number one profitable customer

They refund me activation & installation charge £70 credit back into my account and also refund me partial service charge because of same day upgrade & went back downgrade again after complaints of virgin tech guy not doing their job properly and never check any power level signals.
I had test it via microsoft technet 3.2gb windows 7 iso and speed was all over the place via ethernet cable with a transfer rate of 1.19Mb/s to 4.78Mb/s never get anywhere near 5Mb/s or 10Mb/s.
After downgrade back to 30Meg, it download transfer rate steady and solid at 3.9Mb/s all times.
It appear very poor indeed for 100Meg as I don't know if it was to do with superhub cannot cope with 100Meg or something to do with incorrect power level signals or could be secret hidden traffic shaping.
100Meg isn't worth it to be honest, waste of £45 a month for silly low speed!

Re: Finally arrives here !
Pretty incompetent on VM's part. After all the modifications and up and downgrades on your account should have actually held you to the contract for a change.
Everything is fine, as speeds go up so transfers get more inconsistent. Being realistic with expectations is very wise.

Except they probably legally can't
DSR and Right to Cancel and all that
Plus their own 28 MBG policy

Re: Finally arrives here !
The DSR right to cancel doesn't cover services that have already begun being provided, i.e. he loses his right to cancel as soon as it's turned on. That just leaves VM's own 28-day MBG, which could be wrangled out of as he's upgrading an existing service, not taking a new one.

If it's a new contract (which 100Mbit) is, then that's not true. The DSR would apply
