They used to, not anymore.
This shouldnt be allowed, it was filed after the release of the iPod! Surely you cant patent something already on the market from another company

Patenting....1st come, 1st served.
Apple should have filed earlier. Doesn't look like it matters that they had a product, using the idea, out on the market first...not if they hadn't patented it first.
Anyway, it's only one patent, relating to something seemingly similar to part of the iPod's UI. It's not like the whole iPod.
