Anyone here from NTL legal?
Just seen this on my other port of call in the evenings and I'm wondering if anyone from NTL can clarify if its theft of service and a breech of the contract?

It is theft because you are stealing bandwidth you have not paid for and you only obtain higher speeds by hacking which again is illegal.

Which is what we keep telling anyone that asks  He seems to think otherwise though  The number of times we get posts like that and have to delete or close them  Even had someone post the instructions to do it once

It is theft, you are stealing bandwidth you have not paid for - you are defrauding ntl.
It is also, of course, totally against your T&C's to intefere with your CM in any way.

It looks like he's talking hypothetically. They cant actually do anything to him until he's actually modified his STB/SACM from the agreed service that he pays for.

He hasn't done it yet but is thinking about it  Even after being told it's illegal he is still going to try it  Doesn't see where it's illegal

Do you have access to his ip address through that forum? if not you can suggest to the owner of the forum that he reports the details with the ip address to ntl abuse.

yes it would be, but there is only so much that you can do
I am sure that his legal advise is not correct... if he is indeed citing draft legislation, then it is not legally binding anyway!
Some people only learn by getting punished for their mistakes so just have to wait and see what happens!

Oh dear, I've seen this before, when someone is confronted when they are doing something wrong, they pull some BS out of the bag, that their spouse, friend, neighbours dog etc., knows the law and has told them that is OK to continue with what they are doing. Then they never post back again to defend themselves because they know that they are in the wrong.

His wife is not the only one doing a law degree....
He is correct in saying that there is no precedent (which btw he can't spell) on the subject.
His wife may be thinking that stealing bandwidth is not theft under the theft act 1968, but would probably be interpreted as obtaining services by deception under the 1978 Theft act (section 16).
As for the white paper mentioned, i have checked and can find no evidence of such a paper... i am prepared to be proved wrong on this one though!
