Just to let you know finally found the solution - its the modem it cant run a 10mb service on it.....
So ring Ntl - email um this and then basically say they have to upgrade ure modem......

This modem has only a 10BaseT Ethernet connection, thus will limit your
throughput setting of anything above 3-6Mbps.

I would say that reply you received is a load of nonsense to be fair. Im using the exact same modem and apart from the first few months when 10mb was launched in my area and things were rocky to say the least (Glasgow, Nov 2005) i now consistently hit the 10mb speeds, sometimes going even slightly faster.
