No charge for Texas dad who killed daughter's rapist
I have nothing but respect for the people who made this decision
Quote:
A US father who found his five-year-old daughter being raped, then beat the attacker to death will not be charged, prosecutors have said.
The 23-year-old man told police he found the girl being assaulted on Saturday 9 June by Jesus Mora Flores in a rural part of southern Texas.
A grand jury has declined to indict the man, finding that he was allowed to use deadly force to protect his daughter.

A excellent decision.

Somehow I suspect you wouldn't get a similar verdict in this country. The Yanks have a greater tolerance than us for use of force, why else are there so many guns available, and a consequence of that is that deadly force is more readily anticipated whereas in the UK we seem to prefer reasonable force, which means that you have to back off when the threat has subsided.

I think he probably did what most fathers would have done in similar circumstances.
Hope he and his daughter manage to get over this ordeal.

I'm not too sure about that. It's not as if you can't use violence, the issue is whether the violence is proportional. We're talking about an extreme situation here. He didn't shoot someone making a getaway after stealing a lawn mower from the shed. Also, he called 911, telling them the guy was dying, so he didn't keep punching the guy until he was dead. Given what we know, it sounds like proportional use of force to me, and I'd be surprised if the verdict were different here.

I think you are correct ,i believe there are cases where it has been decided that it is not in the public interest to prosecute the death of a criminal such as this recent one .I would still be worried though because of the inconsistencies in our justice system

Finally someone in this world with common sense. I would have done the exact same thing myself.

No question about that. I just hope the family get over it.

If he had shot him then the case would have been all about whether he picked the shotgun up before he hunted for the rapist, or whether he happened to have it on him at the time, or whether deadly force includes shooting people.
I would have done the same.
