Eclipse Taken My Money
Hello.
On the 18/01/2007 I ordered some stuff from Eclipse Computers. After waiting 5 days on a 'next day' delivery, I emailed them to ask about the delay. They informed me that 2 of the items I ordered were out of stock. I cancelled my order there and then, because I don't like being kept in the dark about stuff. I received the email from them saying the order was cancelled.
Since then, I have not had any money returned to me. None of the items showed up (obviously), and Eclipse have ignored my emails. I was waiting until today for my statement to come through to check it, and I see it isn't on there.
What can I do? The amount is for £41.48, so I do not want to give it up as a lost cause.

ive said time and time again on this forum to call Eclipse before ordering as there website does not have upto date stock information. Im going into the shop today to return some faulty ram want me to punch someone lol

In fairness, they shouldn't have taken the money if the item(s) weren't in stock.

Usually they take the money once the items are ready to ship, or have shipped.
Obviously, I won't be using them ever again.
If they don't reply to my email (I sent another one just now), what would be my next course of action?

The only one that I know that doesn't take money if not in stock is Amazon.

I used to deal a lot with Amazon, maybe that is where I got this preconceived notion.

I contacted Consumer Direct, to get their opinion. This is what they had to say:

From the information you provide, if the company have failed to deliver the goods you ordered you would have the right to claim a full refund. Your claim would be for a breach of the Consumer Protection (Distance Selling) Regulations 2000 and the company should refund you within 30 days of the order being cancelled.
I would recommend that you send the company a recorded delivery letter, summarising what has happened and making “time of the essence†(i.e.7 working days) for a refund to be made.
If the company fail to refund within the deadline, please contact Consumer Direct again for further advice, either by email or telephone 08454 04 05 06.

Sounds helpful. I think I will wait a few days for a reply to my latest email, and then send them a recorded letter and an email. Hopefully the threat of action will put the willy up 'em and they'll reply via email and save me the time waiting for them to 'lose' the letter.

I can only comment based on what I read there, but the magazine ComputerActive has a regular section where they act on behalf of people with problems like yours. They do seem to be fairly successful so it might be worthwhile giving them a try. Buy a copy and see; it costs under £2.
