Appeal won
http://news.bbc.co.uk/1/hi/wales/4506625.stm
Another appeal won, again due to a co*k-up!
The appeal evidence seems to of centred on his solicitors conflict of interest, the case was big headlines in Wales at the time, and it looks like there are a few possibilities in this case.
A) The police fabricated evidence due to serving police officers being originally questioned over the incident.
B) The solicitor could of been involved in a corrupt set-up.
C) The guy could of actually be innocent of the charges.
D) The guy has got off on a technicality.
I always wonder in these sort of appeals if we can have 100% faith in the appeal decision.

Re: Appeal won
In murder / criminal cases, you have to establish the evidence / case "beyond reasonable doubt", what this has shown is that this may not originally have been established beyond reasonable doubt, thus overturned, no technicality.
A retrial has been required, he is yet to be proven innocent.

Well, not so much 'appeal won' as 'retrial ordered'. The chap is still a prime suspect, but there are other suspects in what is a *very* unpleasant and murky matter. Surely the truth should be out in the open? The only way to do this is to have proper, fair court proceedings, and obviously having the same solicitor representing two different suspects in the same case raises questions about quite how fairly he represents them.
Mind you, there's nothing to stop the guy suing his original lawyer for failing to do a proper job. That would be an interesting case.
You can never have 100% faith in the system, because it's run by humans. The important thing is that there is a system, and it should be open and fair to all.

Re: Appeal won
The fact that a retrial has been ordered means (IMO) that the system is actually working. Mistakes were made (whether by, erm, mistake or deliberately) in the original trial, and hopefully these will be corrected.

Re: Appeal won
The Clydach murders caused a great deal of anxiety, misery and anger in the South Wales communities. There has always beena belief that the police were somehow invovled because evidence shows that one of the officers originally arrested was around that area that night and failed to log in to his office.
In any case, South Wales Police are being investigated for corruption and ineptitude with the Lynnette White case so I see no reason why this case should not be opened up again.
Michael Mansfield QC was integral in the defence of the notorious Cardiff Three who were bullied, belittled and subjected to all sorts of abuse by the police force. They were released and Jeffrey Gaffoor is now behind bars where he belongs.
If he considers that there is evidence to suggest that David Morris is innocent then let's hear it and let's presume that he has evidence to suggest that someone else was involved as well. I feel for the Power family but in the interests of justice surely if there was no fresh evidence and no belief that this man was not fairly represented then there should be an inquiry at the very least.

Yeah, what he ^^^^^^ said.
There is a retrial, so if he is guilty, then he'll go down again, it will just cost us a bit more. He is remanded in custody, which should reassure people. I can't see anything to be worried/upset about here.

Re: Appeal won
Probably - it has been found that the original trial was unfair and a retrial should occur.
He is still held in custody. I wonder where the copper and his missus are and whether they have been taken into custody pending this retrial.

They've split up. I know both officers plus Mandy's ex lesbian lover and all three slimey pieces of work. That doesn't make them guilty....although the retrial should.

Re: Appeal won
I notice the prosecution have made an application for costs....
will be amusing when the solicitor in question picks up the bill.... estimated to be around £3mil at the moment
