Re: teacher jailed !!!!!!
Clearly, she had just cause for complaint, very sad, but she should have realsied the significance of what she was doing. She must surely know there are channels for dealing with these issues and not use a weapon, no matter how careful she may have been.

Agreed. She should also have been aware of the firearm laws. Clearly provoked but not an excuse for taking pot shots at people.

Re: teacher jailed !!!!!!
6 months for firing a pellet gun into the ground? What is it with the legal system in this country?
People live in fear on some estates where yobs/scrotes/********* terrorise everyone, nothing gets done or the idiots get a caution
The only thing I will say is that since she decided to phone the police and say
Quote:
|
"I'm going over to that field over the road, I've got an air rifle and a pistol and I'm going to shoot the vandals that come around here."
|
she might have gotten away with a caution for it

Re: teacher jailed !!!!!!
She suffered something chronic, I do feel for her, I know what thats like... the punishment was waaay out of proportion for the crime. Would the little scrotes get 6 months porridge for shooting at her with an air pistol?

But my understanding is that there was no evidence at all that the kids she fired the air rifle at were guilty of anti-social behaviour. Also, the police said that there was no evidence that she had suffered harrassment, which would imply that if she was on the receiving end she didn't report it.
And it wasn't on the spur of the moment; she actually phoned the police & said she would do it; that sounds like it was premeditated to me.
Having said that, it's difficult to see how the wider community will be best served by sending her to prison; as a special needs teacher she would have had a criminal records vet, so presumably has no or only insignificant previous record.
Perhaps there's more to this than is being reported ?

Quite probably, nothing is ever clear cut.
The way I look at it, you have one person saying something on one side, and some other person saying something entirely difference on the other. The truth is always somewhere in the middle, but as to where it lies, its just experience reading between the lines.
Its improtant to know though, that anti-social crime is considered so minor that there probably wouldn't be much trace of it reported, unless the kids were arrested, which is rare...
Courts can't seem to condone the behavior, but throwing her in jail when there are so many more deserving people that should be there is wrong. She should have got a suspended sentence. A big slap on the wrist, but not THAT big.. The court accuses her of being disproportionate.
Also.. I am suprised she wasn't cleared under the new intrepretation of the laws which say if you feel threatened, you can respond in kind. Certainly a woman on her own versus some young strong trouble causing lads, should be plenty believeable that she was frightened?

Well the whole point of this new intrepretions about using force is that it is supposed to stop you looking at 3 different weapons and thinking... what will get me in the least amount of trouble? You just grab which one makes you most comfortable.
If you could call it using force... noone was hit by it. And it was an air gun.

Not if you phone the police and tell them 'I am going over to that field across the road with a gun'. I think that's what got her the prison sentence. As Cookie says, it is premeditated and it is hard to argue that you feel threatened (which she could have done if an intruder was in her house)
