Turned out to be a faulty connector in the street. As I thought I was losing upstream power, 12db. Add a further 3 db loss (more with 3 way splitter) from the splitter that takes me over the acceptable loss threshold when the splitter was connected. That was why I could connect without the splitter. The engineer replaced the connector in the street and disconected a 10db attenuator from the back of the modem (did not even notice it??)

Back to my three way splitter and everything is working great.
