I think you would only be able to ask for compensation if NTL had actually promised you something which they had failed to deliver. Have they written to you saying you would be getting an upgrade and with a specific firm date - if not then where's the grounds to moan and talk about compensation.

The free upgrades only started about 24 hours ago and it's still only unofficially available for existing customers.
