I don't really think it should go to a jury to decide whether she is 'ok or not'. It's not 'ok' for her to have said that. It was horrible. But it shouldn't be a criminal offence. The only time I think speech should be criminalised is if it's direct abuse to someone (i.e racially abusing someone) or an incitement to violence.
Saying horrible things about someone upon their death gives a way of what kind of person you are, but I don't see why it should be literally illegal.
