Isn't this all hot air? I have not heard of any existing legal statute that can be used to force a second Scottish vote.

If there isn't a case in law and since the law for such an instrument is made in Westminster then this is all pointless, right?

Scotland may want to stay in the EU and may want to leave the UK but wanting and getting are two different things.
