If the slope is perfect, sure. Either way the customer is at best within 2dB of dynamic range window violation which is not good.
Given upstreams on the D3 platform start at a centre of 25.8MHz it doesn't seem unlikely there'll be a variance of >2dB between that channel and one in the 70s without adding an extra 10dB.

That adding kit onto the end of the customer's CPE should be a last resort aren't my words,
