It's because on the TiVo the box is able to use all 3 tuners so the only way to ensure the tuner is free is to set a recording. On the V+ box there is always a tuner dedicated to live TV.

How are you trying to exit the mini guide? If you press TV it will end the recording but if you press clear (below 7) it will close the mini guide and continue playing back
