They don't want to scare potential customers away so its obviously worded carefully. Posts by users in their forums suggest that they do ban people.
Pesonally what I find more important is that there is usually no clear explanation when signing up to these services as to what limits their 'unlimted' services have and if it applies to just phone data or tethering too. We use mobile data in many ways now and its easy to get caught out.
Three has unlmited data, even if you tether. Giffgaff claim unlimited but can ban you for hitting their pre-determined limit per hour and day. They also don't let you tether. My issue is both are advertised as unlimited but one product is clearly different from the other.
Its the same as virgins unlimited broadband which has many limits, unlike sky And bt's unlimted
