The limits imposed by the stm policy are for total volume traffic which apply everyday of the week regardless of what you download. They will affect either your downstream or upstream though, not both unless you have exceeded both limits. As an example, if you download a tonne of stuff your downstream will go to 50% for 5 hours but your upstream will stay at 100% unless you upload a tonne of stuff as well.
P2P throttling/shaping or whatever you want to call it is completely different. There are no restriction on torrent traffic/newsgroups etc apart from those imposed by the stm policy but during peak hours they actively throttle p2p traffic by flagging it as low priority on the network. Basically during busy periods like today where everyone is on the internet doing stuff if you decide you want to torrent all day you arent going to get your full speed. Everyone's youtubing and everything else gets priority and whatever juice is left on the line is what you get which can piddly amount like 100k/sec. It is a fair policy though because most evenings I can still get ~7mb/sec on torrents and on Friday evening I pretty much got full speed which I was really impressed with. You can hammer it all you want though and you'll still get hit with stm once you hit that theshold.
