He didn't shoot someone making a getaway after stealing a lawn mower from the shed. Also, he called 911, telling them the guy was dying, so he didn't keep punching the guy until he was dead. Given what we know, it sounds like proportional use of force to me, and I'd be surprised if the verdict were different here.
