Has your insurer actually told you that? The reason I ask is because according to Watchdog most of them do it.
If it was someone in the courts, then I should think they are breaking the law. Unless it was just the press release, but that shouldn't give out your personal details.
They can get your phone number and the bill payers name from a telephone directory database, just like most cold callers. They will then say something like "I'm calling about the accident you had", just in the off chance that you were involved in an accident.
