Do you mean "being guilty" or "being found guilty"? You are punished in court if you admit guilt, or are found guilty. It's entirely possible to actually be guilty without being found guilty. Look at the previous trial of Gary Dobson and David Norris. They were clearly guilty (as evidenced by the results of the trial that ended today), but were acquitted, not found guilty.
