You can defeat the P2P and newsgroup throttling with a combination of techniques. On newsgroups make sure you have an SSL encrypted connection to the server, preferably not on the default port (port 443 is a good). Make sure protocol encryption is enabled for BitTorrent and eMule.

The second technique is to open more connections. VM's throttling isn't very effective when you have many, many connections. With newsgroups experiment by increasing the number of connections until you can saturate your line 24/7.

Unfortunately this all creates far worse network issues for VM and other uses, including reduced bandwidth, increased latency and increased jitter. Like many other ISPs Virgin appears to have found that the more they fight the worse it gets, so recently have tried adding more bandwidth instead which seems to be working much better.
