no, surely if your on up to 10mb and you get 9.98 then your line is capable to 9.98
when traffic management kicks in, the UBR limits your speed to 2.5mb, you will still be connected at 9.98 but will not be able to use more than 2.5, so you should be getting 2.5 exactly under management

the OP says they are being limited to 1.67
to clarify, are we talking about the STM or p2p management?
