This phone had Wifi but for some reason whilst connected to Wifi also used the 3G connection.

If we knew HOW the phone had been using the data connection every 15 seconds then it would explain the usage, but since nobody can tell us that then I am not willing to pay.

No Smart Phone on the market should be using that type of amount of data in 9 days just for push mail....

I doubt it will come to it, but I will be willing to take it to small claims.

Heck, they have a £150 credit limit on the account so how did it get to £250 anyway (they misunderstand the difference between limited and unlimited......)
