If he has an illegal modem it cannot affect your connection and you switching on your modem and pc will have no effect on him.

Quite often as a temporary fix 2 neighbours will be temporarily linked to the same cable if the is a fault while repairs are carried out.

One could be on 20Mb and the neighbour may have our size S 2Mb package, but as both modems are correctly provisioned on the network then they will only receive the broadband package they are paying for.

He is not using your connection as it is NOT POSSIBLE.
