Seems like a fairly sweeping statement to make considering the apparent ignorance; takes all sorts I suppose. I'd have thought it would ultimately depend upon the nature/details of the issue, which is why I bracketed the suggestion in the response I provided.
Regardless, a solicitior will be able to advise (more than likely for free) whether or not there is a case (or not) and if it's worth pursuing.
