We only have Hull's word on whether he was spitting "at" someone.
Brown has done a good job at Hull but there was clearly a large element of sour grapes.
He complained about Fabregas being on the pitch, how Fabregas was dressed (Have you seen some of your own jackets Phil?) and finally accused Fabregas of turning round and spitting at his assistant's feet. I don't think that would ever be classed as an assault even if the police had witnessed it.
Now if it was a Brian McClair nose clearance then that would have been a different matter.

One of those could easily taken you feet away.
