the service i still have was based on a renewal. which was done expressely on the condition that i would not pay a setup /etc fee for the upgrade as i wanted 50mb. i made it clear that i did not want to renew if they would charge me for an upgrade in a weeks time if 50mb appeared in my neighborhood. it was part of the verbal contract and understanding, and the email they sent through clarifies the situation - that my plan has been renewed and i do not need to pay for an upgrade to XXL.

i'm more than willing to take this to small claims court if they go back on this, i've done it with O2 where they ended up reimbursing me Â£300 for a Â£36 error the day before i was going to file at the courts. i'll no doubt fight virginmedia to the end on this one.
