You can go with either O2 or Apple.

As you bought it off O2, your contract is with them (the retailer) under the Sale of Goods Act 1979 (as amended), & it is their legal obligation to ensure that the goods are of satisfactory quality, fit for purpose, conform to contract etc.

But you also have a manufacturer's warranty with Apple, which is in addition to your statutory rights as a consumer. If you take the manufacturer's warranty route, I believe that you give up the right to later claim against the retailer for any subsequent faults.



When I got my old SE P900 off O2 way back in 2003 (I think), the first one was faulty. I just got it swapped out at the O2 shop.
