Remember, VM define capping as a physical limit on what you can download. They ignore the speed you can download it. So, they would count a service that either stops your internet connection, or charges you a premium when you go above a certain limit. They do not count their own service which slows your connection, but does not actually stop it, or charge you extra for going over the cap.
I am not saying they are right, just stating how they define "capping".
