The changes to their web site re: Opt-In/Opt-Out clearly illustrates that they are still planning to use an Opt-Out model (or they would just say it is Opt-In and avoid mentioning Opt-Out at all).
Last time I saw that much BS was when I was visiting a farm in the country last year with my son. Their "new" website is quite amusing though, they are very clearly on the defensive and seem very worried that they are screwed, which is understandable because they are screwed.
